Part A - Terms of Service

A1. About Everdawn and these terms

Everdawn is a free, fan-run Minecraft: Java Edition server at play.everdawnmc.net, with a Discord server and this website (everdawnmc.net). It is run by Maxim Bozek ("we", "us"). Contact details are in C4.

By joining the Minecraft server, our Discord server or using this website, you agree to these terms, to our rules (shown in full in game with /rules) and to how we handle data as described in our Privacy Policy. If you don't agree, please don't use Everdawn. If you're under 18, please read these terms together with a parent or guardian.

A2. Not an official Minecraft product

Minecraft is a trademark of Mojang Synergies AB. Mojang and Microsoft don't run, endorse or support Everdawn and aren't responsible for it or for anything sold here. When you play, you also have to follow the Minecraft End User License Agreement and Microsoft's terms for your account. We run Everdawn in line with the Minecraft Usage Guidelines - which is one reason nothing that affects gameplay is ever sold.

A3. Who can use Everdawn

• You need a genuine Minecraft: Java Edition account. Cracked or offline-mode clients can't connect.
• Players of all ages are welcome on the Minecraft server. Our Discord server follows Discord's minimum age (13, or higher where local law requires it).
• You can't use Everdawn if we've banned you, and you must not use another account to get around a ban.

A4. Your account

• You're responsible for what happens on your account. Keep your Microsoft account secure; we recommend linking your Discord account, which turns on our login protection.
• Don't share, lend, sell or buy accounts. Only a limited number of accounts may join from one internet connection (to stop alt abuse); if your family plays from one home and hits the limit, ask us on Discord.
• If you think someone else has used your account, tell us straight away so we can help and check what happened.

A5. Rules and behaviour

Our rules are part of these terms. In short: be kind; keep chat clean; never share anyone's personal information (including your own); play fair; respect other people's builds; trade honestly. Everdawn has younger players, so we are strict about anything sexual, hateful, threatening or predatory - that means an immediate ban and, where required, a report to the authorities.

Staff may act against behaviour that harms the community even if a rule doesn't mention it word for word. Report rule breakers with /report instead of taking revenge.

A6. Chat, private messages and safety

Chat is filtered automatically. Public chat, team chat and private messages are logged and can be read by staff so they can protect players - see the Privacy Policy for what is kept and for how long. Private messages are private from other players, not from staff. Use /block to hide someone, and turn on Quiet mode or other options in /settings if you want a calmer chat.

A7. Mods, cheats and exploits

• Allowed: performance and visual mods (for example Sodium, Iris, OptiFine) and minimaps without entity or cave radar.
• Not allowed: hacked or cheat clients, x-ray (mods, texture packs or tricks), macros and autoclickers, and any automation that plays for you.
• Bugs and dupes: report them with /bug instead of using them. Items, coins or progress gained from a bug, dupe or exploit can be removed.

A8. Your content

You keep the rights to what you create - builds, signs, chat messages, suggestions and so on. So that Everdawn can work, you give us a free, non-exclusive, worldwide licence to store, show and use it within Everdawn and when showing off the server (for example, a screenshot of spawn that includes your build on our website or Discord). This licence ends when the content is removed, except where it's already part of a published screenshot or video.

Don't post anything illegal, anything that infringes someone else's rights, or anything that breaks our rules. We can remove or change content that does, and we may reset or remove builds in the shared world, for example when a region regrows or a season changes.

A9. Coins, items and other virtual things

• Coins, crate keys, items, tags, plots, perks, relics and everything else in the game are part of the game. They have no real-world value, aren't your property and can't be exchanged for money.
• No real-money trading: you must not sell, buy or trade anything from Everdawn (or accounts) for real money or for things outside the game.
• We may rebalance the game - for example prices, rewards or drop rates - and fix bugs. We may remove things obtained by breaking the rules or through bugs.
• We won't take away things you earned fairly, including perks you bought with coins, just to turn them into Supporter perks.

A10. Moderation, punishments and appeals

• Depending on how serious a rule break is, staff can give warnings, mutes, kicks, temporary or permanent bans, remove items or reset progress. Every ban gets an id so it can be appealed.
• Some protections are automatic (chat filter, a short auto-mute after several warnings, anti-cheat, macro checks, item protection, login limits). Bans are always decided by a person. See the Privacy Policy.
• Appeals: if you think a punishment was wrong, appeal politely on our Discord (open a ticket and include the ban id) or by email. A different staff member than the one who punished you will look at it where possible.
• A punishment for breaking the rules doesn't entitle you to any refund (see B8).

A11. Discord

Our Discord server is also covered by Discord's Terms of Service and Community Guidelines. Our rules apply there too. Our bot offers features such as account linking, support tickets, rewards and staff applications; ticket transcripts are kept for staff (see the Privacy Policy).

A12. This website and other sites

This website is for information and for the Supporter store. Links to other websites - such as Discord, PayPal and the server lists you can vote on - take you to services we don't control; their own terms and privacy policies apply there.

A13. Availability and changes

Everdawn is a free hobby project provided "as is". We work hard to keep it online, but there will be restarts, maintenance, updates and sometimes outages. We may change, add or remove features, worlds and game content. If we ever decide to close Everdawn for good, we'll announce it on Discord and this website as early as we can.

A14. Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, for intentional or grossly negligent behaviour, or any other liability that can't be limited by law. Apart from that, and because Part A covers a free service, we are not liable for lost progress, items, coins or builds, or for the server being unavailable. For the Supporter rank, your rights as a consumer are described in Part B and are not limited by this section.

A15. Ending your use

You can stop using Everdawn at any time, and ask us to delete your data (see the Privacy Policy). We can suspend or end your access if you break these terms or the rules - see A10.

Part B - Terms of Sale (Supporter rank)

These Terms of Sale apply when you buy the Supporter rank on everdawnmc.net. Please read them before buying - at checkout you tick a box to confirm you agree. You can save or print this page; the version that applies to your purchase is the one shown when you bought (the date at the top).

B2. What you're buying

The Supporter rank is a digital product: a set of cosmetic and convenience perks for one Minecraft: Java Edition account on the Everdawn server. It never gives coins, keys, gear, stats or anything else that makes you stronger or gives an advantage in the game. The rank includes:

1. Gold [Supporter] badge in chat and tab.
2. Name colour picker (Settings, 12 colours) - your name in chat and tab.
3. Chat colours + bold/italic formatting.
4. Exclusive Supporter trail, plus every normal trail unlocked.
5. Kill & death effects in PvP (3-4 styles, Settings).
6. Your own join message (write it yourself, filtered, max 48 characters) + a small join firework.
7. /hat.
8. Every monthly Supporter-only tag (a new exclusive tag each month, automatically given to all supporters).
9. Your name on the Supporter Wall at spawn and the website thank-you list (only if you chose "show my name").
10. Priority join when the server is full.
11. Discord: gold Supporter role + a private #supporters channel (needs your Discord account linked with /discord link).

Some options in /settings are marked "Supporter only" - those are part of the perks above. Safety, comfort and accessibility settings (such as Quiet mode, chat filters, pings, blocking, messages, sounds and the sidebar) are free for everyone and will never be locked.

Apart from the normal trails, which can still be earned with coins, these perks can only be had through the rank. Players who earned chat colours, a coloured nickname or /hat in game before the rank existed keep them (see A9).

B3. Price and payment

• The price is $5.00 (US dollars), once. This is the total price, including any taxes that apply. There's no subscription and nothing renews automatically.
• Payment is made through PayPal (with a PayPal balance, bank account or card, as PayPal offers). PayPal's terms apply to the payment itself. If your money isn't in US dollars, PayPal or your bank converts it and may charge a conversion fee - we don't receive that fee.
• We never see or store your card or bank details.

B4. How a purchase works

1. You enter the Minecraft name the rank is for (it can be a friend's) and confirm the account shown is the right one. You can go back and change the name at any time before paying.
2. You tick three required boxes: that you agree to these Terms of Sale and the Privacy Policy; that you want the rank delivered immediately and understand that you lose your 14-day right of withdrawal once it is delivered; and that you're 18 or older or have a parent's or guardian's permission. Without them, the PayPal button stays locked.
3. You click the PayPal button and approve the payment in PayPal's window, which shows the item and the price once more. Approving it is your binding offer to buy.
4. We accept by capturing the payment straight away. The contract is made at that moment. The page then says "Thank you", and PayPal emails you a receipt that includes the order description and the confirmation of your withdrawal waiver (see B9).

The contract is in English. We store the order details, including your checkout confirmations and when you gave them; these terms stay available on this page.

B5. Delivery

• The rank is delivered automatically, usually within a minute of payment. "Delivered" means the rank has been applied to the Minecraft account you chose on our server - you don't need to be online; if you're offline, the perks are waiting when you next join.
• If the game server is restarting or offline, delivery is queued and happens automatically as soon as it's back, normally within minutes. If PayPal holds the payment for review, the rank is delivered once PayPal clears it.
• If you haven't received your rank within 72 hours of paying, contact us: we'll deliver it by hand or, if we can't, refund you in full.

B6. How long the rank lasts

• The rank is permanent for as long as Everdawn runs. It is tied to your Minecraft account (its UUID), so it stays if you change your Minecraft name, and it isn't affected by map resets or seasons.
• If Everdawn closes for good, the rank ends with it. We'll announce a planned closure on Discord and this website as early as we can. Because the rank is a one-time purchase that supports the server for as long as it runs, there's no refund when the server closes - this doesn't affect any rights mandatory consumer law gives you.

B7. Changes to perks

Minecraft, Mojang's guidelines and our server change over time. We may change, replace or improve individual perks for a valid reason - for example technical changes, a Minecraft update, the Minecraft Usage Guidelines, abuse, or to keep perks cosmetic. Changes come at no extra cost, and we'll never remove the rank itself or make it pay-to-win. If a change would make your access to or use of the rank worse in more than a minor way, we'll tell you clearly in advance, and you then have the rights the law gives you - including ending the contract free of charge within 30 days and getting back the part of the price the law requires.

B8. Bans, account problems and transfers

• The Supporter rank doesn't put you above the rules. If your account is banned, the rank stays on the account but can't be used while the ban lasts; if the ban is lifted, it works again. There is no refund for a ban or mute given for breaking the rules.
• The rank has no cash value and is not transferable: it can't be moved to another account, sold, or exchanged for money, coins or items.
• Bought it for the wrong name by mistake? Contact us straight away and we'll look at it case by case.

B9. Right of withdrawal

If you're a consumer in the EU/EEA or the UK, you normally have 14 days to withdraw from an online purchase without giving a reason. For digital content that isn't supplied on a physical medium, the law lets this right end once delivery has begun, provided that you expressly asked for immediate delivery, you acknowledged that you lose your right of withdrawal as a result, and the seller confirmed this to you on a durable medium (Art. 16(m) of the EU Consumer Rights Directive 2011/83/EU; in the UK, regulation 37 of the Consumer Contracts Regulations 2013).

• Your request and acknowledgement: the second required checkbox at checkout - "I want my rank delivered immediately and I understand that I lose my 14-day right of withdrawal once it is delivered". We only sell with immediate delivery, so the rank can't be bought without it.
• Our confirmation: the order description on your PayPal receipt, which PayPal emails to you, reads "Immediate delivery requested; 14-day withdrawal right waived." We also store your confirmation and its time with the order.
• Result: once the rank is delivered, you can no longer withdraw. Until it has been delivered - for example while delivery is queued - you still can: email us and we'll cancel the delivery and refund you in full.

B10. Refunds, faults and your legal rights

No refunds are given after delivery just because you changed your mind, stopped playing or were banned for breaking the rules. You do get your money back if the rank isn't delivered, if it doesn't work and we can't fix it within a reasonable time, if you were charged twice, or if the payment wasn't authorised by the account holder - see the Refund & Withdrawal Policy. Your statutory rights for digital content that isn't as described or doesn't work (having it fixed, a price reduction or ending the contract) always remain and aren't limited by these terms.

B11. Chargebacks and PayPal disputes

If something's wrong, please contact us before opening a PayPal dispute or a chargeback with your bank - most problems are solved within a day. A refund, chargeback or payment reversal removes the Supporter rank automatically. If a dispute is closed in our favour, you can ask us to restore the rank.

B12. Buyers under 18

If you're under 18, you need permission from a parent or guardian before buying - you confirm this with the third checkbox at checkout. PayPal accounts are for adults, so a parent usually pays. If a parent or guardian tells us a child bought the rank without permission, we'll work it out with them - normally by refunding the payment and removing the rank.

B13. Where the money goes

Everdawn has no investors or ads. Money from the Supporter rank helps pay for the server, hosting and tools that keep Everdawn online. It is a purchase of the rank described above, not a charitable donation.

Part C - General

C1. Changes to these terms

We may update these terms, for example when we add features or the law changes. The date at the top shows the current version, and we'll announce important changes on Discord and this website before they take effect. If you keep using Everdawn after that, the new Terms of Service apply. A purchase is always governed by the Terms of Sale that applied when you bought, unless a change is only in your favour.

C2. Governing law and disputes

These terms are governed by the law of the country where the seller has his habitual residence. If you are a consumer, this choice of law never takes away the protection of the mandatory consumer laws of the country where you live (Art. 6(2) of the Rome I Regulation), and you can bring a claim in the courts of your own country. We don't take part in alternative dispute resolution procedures before a consumer arbitration board, but please talk to us first - we'll do our best to solve any problem fairly.

C3. Other legal points

• If a part of these terms turns out to be invalid, the rest stays in force.
• If we don't enforce a term straight away, we can still enforce it later.
• Headings and the short summaries are there to help you read; the full text is what counts.
